This paper analyses the ensuing consequences, in terms of liability, which parents might incur in when sharing their children’s images in social media, the recently so-called sharenting. We specifically address the meaning of “illegitimate intrusion” and the consent regime for this intrusion when minors’ personality rights are affected. We conclude that sooner rather than later, Courts will have to deal with claims due to infringement of minors’ personality rights as a result of this growing phenomenon.
