Motivos de denegación de la ejecución material de una resolución extranjera y motivos de denegación de su ejecutividad: alegación y procedimiento de exequátur

This work analyzes, from the point of view of the Council Regulation (EC) num. 44/2001, of 22 December 2000, on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, the subject of the different objections of pleading the grounds of refusing the material enforcement of a foreign judgement during the proceedings directed to the declaration of enforceability, taking into account the next application of the Regulation (EU) num. 1215/2012, the European Parliament and of the Council, of December 12, 2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, which eliminates the proceedings for the declaration of enforceability.
