Reflexiones en torno al régimen aplicable a las reclamaciones relativas a responsabilidad no contractual en el ámbito judicial europeo

This paper analyses those relevant elements that allow to identify the non contractual obligations from the EU point of view, namely, Regulation 44/2001 on jurisdiction and the recognition and enforcement of judgements, and Rome II Regulation on the law applicable to non-contractual obligations, describing, above all, the difficulties to get a consistent interpretation of both Regulations. Also, from the point of view of the different special Conventions that, in the Spanish Law, regulate international jurisdiction, recognition and enforcement, and applicable law, in relationship with several non-contractual liabilities. Finally, this paper analyses the statutes that regulate the relationship between the EU Regulations and these different special Conventions on this subject, with different rules depending on the ruled scope and its present or future validity.
