La esperada nueva regulación de la capacidad jurídica en el Código Civil español a la luz del Art. 12 de la Convención de las Naciones Unidas sobre los derechos de las personas con discapacidad, de 13 de diciembre de 2006

This contribution tries to present the outlines of the new regulation of the Spanish Civil code concerning disability, new regulation intended to satisfy the requirements of the UN Convention on the Rights of Persons with Disabilities, especially those resulting from art. 12. To this end, the author highlights the main ideas contained in the aforementioned article to consecutively spotlight the principal steps that should be taken, some of which have already been undertaken by the most recent case-law. The paper concludes with the most relevant ideas arising from the work that the pre-legislative Commission has done, of which the author is a member.
