Incertidumbre y alguna cosa más en la interpretación constitucional del poder normativo sobre la materia civil

Comentario a la STC 132\2019, que resuelve el recurso de inconstitucionalidad contra determinados artículos de la Ley 3\2017, de 15 de febrero, del Libro VI del CCCat

In this paper the author makes a first approach to the STC 132/2019, of November 13th. The Constitutional Court judgement ruled on the appeal filed by the President of the Government against articles 3, 4 and 9 of the Law of the Parliament of Catalonia 3/2017, of 15 February, of the sixth book of the Civil Code of Catalonia, relating to obligations and contracts, and the modifications of the first, second, third, fourth and fifth books. This is the most important decision dictated by the Constitutional Court about article 149.1. 8ª CE. The complex rules contained in this article have produced a very complicated case law, in which few things seem clear. This new judgement directly addresses one of the most difficult issues of the precept: the search for the meaning and scope of the term «bases de las obligaciones contractuales» included in it. Nevertheless, it does not seem to contribute to the necessary clarification of the norm. Quite the contrary, several circumstances anticipate that this resolution will not be definitive, like its opposition to the criteria followed by its precedents together with the hesitations on the aforementioned «bases», as well as the surprising end result.
