Las obras cinematográficas en el marco del convenio de Berna para la protección de las obras literarias y artísticas: apuntes en torno al art. 14 Bis Convenio de Berna

This paper analyses the art. 14 bis Berne Convention related to autorship and first ownership of copyright of a cinematographic work in the context of domestic legislative plurality. On the one hand, the work points out the need for a conflictual rule, in the absence of a international common substantive rule determinning the autorship of a cinematographic work. On the other, the work analyses the solutions offered by the aforementioned art. 14 bis of the Berne Convention, in particular, the ownership of copyright in a cinematographic work as a matter for legislation in the country where protection is claimed or lex loci protectionis, and the substantive restrictions to its scope, noting the rare virtues and, above, all, those deficiencies that make it scarcely useful rule in practice.
