The author of the present article criticizes the inclusion of two books devoted respectively to commercial obligations in general and, to commercial contracts in particular, in the Proposal of Commercial Code. There are two fundamental reasons for this opinion: its remoteness from any comparative model and its unconstitutional character, due to its non-compliance with the distribution of powers set out in articles 149.1.6 and 149.1.8 of the Spanish Constitution.
